By accessing or using diag ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," "your") and diag ("Company," "we," "us," "our"). By creating an account or using any part of the Service, you represent that you are at least 16 years old and have the legal capacity to enter into a contract.
diag is a web-based system architecture diagramming and visualization platform that allows users to create, edit, share, and manage diagrams representing distributed systems, software architecture, and infrastructure.
The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. Features available depend on your subscription plan.

You may not share your account credentials with others or create accounts by automated means. We reserve the right to terminate accounts that violate these Terms.
diag offers a free Starter plan and paid subscription plans (Pro, Team, Enterprise). Paid subscriptions are billed in advance on a monthly or annual basis.
You retain ownership of all diagrams, node data, and other content you create using the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to store and process your User Content solely as necessary to provide and improve the Service.

We do not sell, share, or use your diagram content for purposes other than operating the Service.

The Service, including its design, code, branding, and all content created by us (excluding User Content), is owned by diag and protected by copyright, trademark, and other intellectual property laws.
Nothing in these Terms grants you any rights to use our trademarks, logos, or brand features without our prior written consent.
We may suspend or terminate your account and access to the Service at any time if you violate these Terms, engage in fraudulent activity, or for any other reason with or without notice.
You may terminate your account at any time by contacting us or using the account deletion option in your settings. Upon termination, your right to use the Service ceases immediately.
Upon termination, we will retain your data for 30 days during which you may export your diagrams. After that period, your data may be permanently deleted.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any information provided through the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIAG, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE.
Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.
You agree to indemnify and hold harmless diag and its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
